Unlawful possession or use of any dangerous drug, narcotic, or controlled substance is prohibited in or upon any building or ground of the SUNY College at Brockport or the Educational Opportunity Center. The College will not protect students or other members of the College community from prosecution under the law.
At the beginning of each academic year, the Office of the Vice President for Student Affairs and the Department of University Police should make available to all students a carefully selected packet of informational materials relating to the characteristics and hazards of various drugs, the legal and social implications of illegal drug use, and treatment sources.
As an educational institution, the College has a responsibility to provide all members of the College community with information regarding the dangers and consequences of drug abuse, misuse, and abuse. The faculty and professional staff are encouraged to develop, as part of the regular instructional program and student personnel program, special seminars, lectures, panel discussion and media presentations, and other learning opportunities related to the legal, social, psychological, and physiological aspects of drug use, misuse, and abuse.
Employees who unlawfully manufacture, distribute, dispense, possess, or use a controlled substance will be subject to disciplinary procedures consistent with applicable laws, rules, regulations, and collective bargaining agreements. Employees must abide by the terms of this statement and must notify the Office of Human Resources of any criminal drug statute conviction for a violation occurring in the workplace, or at a work site, no later than five (5) working days after such conviction.
"Controlled Substance" means any substance listed in Schedules I, II, III, IV or V of Section 3306 of the New York State Public Health Law. Generally, this includes barbiturates, amphetamines, LSD compounds, mescaline, psilocybin, DMT, narcotics, opiates and other stimulating, sedative or hallucinogens.
Student members of the College community having problems with the use of alcohol or other drugs are encouraged to seek help at the Student Health Center or Counseling Center on campus. An Employee Assistance Program is available on campus for employees who wish to seek assistance in dealing with drug or alcohol-related problems.
Providing information to law enforcement agencies about drug use by members of the College community is left completely to the discretion of the individual student, faculty, or staff member. Decisions of this nature are a matter of conscience and individuals, in making their decision, should do so with the assurance that the College will support them. In the event that an official investigation occurs, members of the College community, upon request, will be advised of their rights under the law. Legal counsel will not be provided by the College but advice regarding counsel may be unofficially provided by individuals of the College community wishing to do so. All members of the College community are urged to familiarize themselves with the provisions of current law and to govern their conduct accordingly. Applicable law is College policy. Being aware of the consequences, and having been advised and warned by the College, the College expects that individuals who choose to use, sell, or keep drugs in their possession must then be prepared to accept complete responsibility for their actions.
